대안학교 교육과정 법제화 방향

본 연구는 교육과정 정상화를 위해 대안학교 교육과정 법제화가 어떠한 방향으로 전개되어야 할것인가에 대한 논의를 전개하였다. 이 논의에서 첫째, 현행 공교육 체제는 산업화 시대에 유용성을입증하였으나, 정보화․세계화 시대에 대응성을 높이기 위해 학교체제를 다양화하는 방식으로 취하였음을 논의하였다. 그리고 대안학교는 이러한 맥락에서 등장하였음을 밝혔다. 둘째, 대안학교 교육과정 법제의 필요성을 교육과정 정상화를 위한 것임을 논의하고, 현행 교육과정 관련 법의 비판적 분석을 수행하여, 대안학교 교육과정 법제화 방향성 제시의 기초적 지식을 제공하였다. 셋째, 대안학교 교육과정의 법제 현황과 방향을 제시하였다. 여기에서는 대안학교의 법 규정과 정책과제 연구진에 의해 수행된 시행령(안)의 내용을 해설하여 이에 대한 이해를 도왔다. 그리고 대안학교 교육과정 법제화 방향에서는 별도의 새로운 국가수준 교육과정을 제시하기 보다는 법적 규정에 의한 해결책 제시 가능성이 높음을 논의하고, 대안학교의 자율성을 위해서는 교사의 전문적 자율성을, 그리고 국가는 교과통합 학습 프로그램 개발을 통한 지원체제를 정비하는 방향으로 법제화가 추진되어야 함을 논의하였다.

This study is an attempt to discuss the legal issues and some questions on the alternative school from the viewpoint of the normalization of the curriculum. The results of this study are as follows.

First, alternative schools grow from the unsatisfactory result of public education system. and the number of alternative schools is increased continuously. For the settlement of this situation, government legislate for alternative education in 'elementary, secondary educational law'. and the Presidental Decree for alternative school is preparing presently. But the proposal by scholars has been already announced.

Second, The normalization of the curriculum means that the curriculum appropriates to the characteristics of the individuals. The legal provisions related the curriculum are not consistent with the normalization of the curriculum, and I suggest which way to take.

Third, the main issues of the curriculum agrees to the regimentation and self-regulation of education. Alternative school is the same. But I hope that government offers manual for integrated learning program to alternative school, and teachers have professional autonomy for the organization of the curriculum.

The normalization of the curriculum have to do with the rights of education in law field.
